Birth injury medical negligence claim against Frimley Park Hospital
Baby was delivered in June 2003 at Frimley Park Hospital and suffered catastrophic brain injury at the time of his delivery causing quadriplegic cerebral palsy and severe intellectual impairment.
The allegations of medical negligence against the midwifery and medical staff were that they had over augmented the labour with systocinon, had misinterpreted the ctg traces of the baby's heart and had failed to take urgent action to arrange for his delivery in the face of fetal distress. By the time of his delivery, the child had suffered permanent and very severe injury leading to a later diagnosis of cerebral palsy.
Very sadly the child died at the age of 4 from complications of his cerebral palsy.
The case settled in April 2008 by Boyes Turner's cerebral palsy lawyers (without admission of liability) for a substantial confidential sum. The settlement reflected the enormous additional care the child needed during his short lifetime but with a discount to a full value to reflect complexities of the birth injury compensation claim with trial approaching.
